Please read the Official Rules and Regulations (“Official Rules”) of the 5,000 Miles of Wild® Share Your River Story – September 2018 Sweepstakes (“Sweepstakes”). You must agree to accept and comply with the Official Rules to participate in the Sweepstakes. To accept the Official Rules, check the Accept button on the entry page.
NO PURCHASE OR PAYMENT IS NECESSARY FOR ENTRY TO WIN A SWEEPSTAKES PRIZE. MAKING A PURCHASE OR ENTERING THE SWEEPSTAKES MORE THAN ONCE WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
SWEEPSTAKES DESCRIPTION: The Sweepstakes begins at September 1, 2018 at 12:00 a.m. EDT and ends at September 30, 2018 at 11:59 p.m. EDT (the “Sweepstakes Period”). There will one prize awarded at the end of the Sweepstakes Period. Every entrant who submits a river story of their favorite river, which may include a video or short essay with or without an accompanying photo, during the Entry Period (see below) shall be entered to win a Sweepstakes Prize. Each entrant can only win once. For purpose of this Sweepstakes, each river story submitted in the Sweepstakes will be called an (“Entry”).
ELIGIBILITY: The Sweepstakes is open only to legal residents of the United States and the District of Columbia (“U.S.”) who are at least 18 years of age on the date of the entry submission (“Entrant”). Internet access is required. Employees, directors, and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of the Sweepstakes Sponsor (as defined below), and their respective parent companies, subsidiaries and affiliates, distributors, dealerships and companies involved in the implementation and execution of the Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible.

SOCIAL MEDIA RULES: ENTRY INTO THIS SWEEPSTAKES CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES AND ALL APPLICABLE RULES OF FACEBOOK, TWITTER, AND INSTAGRAM.
FACEBOOK, TWITTER, AND INSTAGRAM DO NOT SPONSOR, PROMOTE, ENDORSE, OR ADMINISTER THIS SWEEPSTAKES. INFORMATION GIVEN TO PARTICIPATE IS PROVIDED TO THE SPONSOR, NOT TO FACEBOOK, TWITTER, OR INSTAGRAM.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER: To enter the Sweepstakes, visit the 5,000 Miles of Wild® web site at https://www.5000miles.org/share-story-alpacka-raft/ (the “Website”) during the Sweepstakes Period, complete the online entry form with the required contact information, and submit the completed Entry as directed.
ALTERNATIVE METHOD OF ENTRY: Alternatively, you may email [email protected] with the subject line “5,000 Miles of Wild® Share Your River Story – September 2018 Sweepstakes” and include your name, address, email address, and telephone number.
LIMIT: Each entrant may submit one unique Entry. Entries will be determined by the authorized account holder of the email address submitted at the time of Entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. The potential winner may be required to show proof of being the authorized account holder. No mechanical reproductions permitted. The Sponsor is not liable for lost, late, misdirected, or corrupted Entries whether due to a technical error or otherwise. Entries are subject to ownership rights as described in the “Use of Entry” section below and will not be returned.
WINNER SELECTION: One winner will be selected in a random drawing conducted on or about the day following the Entry Period, from among all eligible entries received. Drawing will be conducted by Sponsor at the Sponsor’s address. The potential winners will be notified by the Sponsor by email. The odds of winning one of the drawings depend upon the number of eligible Entries received during the Sweepstakes Period. If selected as the winner, the winner must consent to the following:
If a prize is refused, a prize notification is returned or deemed undeliverable, or the potential winner is disqualified for any reason, an alternate winner will be selected via a random drawing. Colors and/or sizes of prizes (if applicable) are subject to availability and are at the Sponsor’s sole discretion.
ODDS OF WINNING: The odds of winning are dependent on the number of Entrants.
DESCRIPTION OF PRIZE: Alpacka Raft® Scout Raft, Approximate Retail Value: $595
Sponsor reserves the right to adjust any deadline(s) as the result of causes beyond its immediate control.
GENERAL PRIZE RESTRICTIONS: A prize winner must take delivery of the prize within 30 days of notice of availability from the Sponsor or the prize may be forfeited and awarded to an alternate winner. Sponsor will be responsible for transport costs of delivering the prize to winner and delivery will be transmitted via US Postal Service or through another method determined by Sponsor to winner’s email address or residence. The prize may not be transferred or assigned until after the actual winner has complied with all his or her obligations under these Official Rules. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion.
The prize winner will be responsible for all taxes (including but not limited to federal, state, local and/or income) on the prize and will be required to provide his/her Social Security number for tax reporting purposes if the retail value of the prize being awarded is $600.00 or greater (as determined in Sponsor’s sole discretion). Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the prize if the retail value of such prize if $600.00 or greater. If a prize winner refuses to provide his/her Social Security number for a prize worth $600.00 or greater, the prize winner will be disqualified and an alternate winner will be selected in accordance with these Official Rules. A prize winner who refuses to provide a Social Security number for a prize worth $600.00 or more will have no right to an alternate prize worth less than $600.00 in lieu of providing his/her Social Security number for the original prize. The grand prize winner will be required to execute an Affidavit and Release form prior to the prize being released to such winner. The execution of an Affidavit and Release by the grand prize winner is an explicit condition to releasing said prize; refusal by the winner to execute the Affidavit and Release will result in disqualification, and a new grand prize winner will be selected in accordance with these Official Rules.
USE OF ENTRY: Other than what is set forth below, Sponsor is not claiming any ownership rights to the Entry. Your river story will be credited with the caption “© Entrant’s Name.” However, by submitting your Entry, you warrant that such Entry shall not infringe on any third parties’ rights, including, but not limited to, copyrights. Entrant affirms, represents, and/or warrants that it: (i) owns or has the necessary licenses, rights, consents, and permissions necessary for the purposes contemplated by this Agreement; (ii) has the written consent, release, and/or permission of each and every identifiable individual person in the Entry to use that person’s name or likeness in the manner contemplated by this Agreement (Permission to publish images of children must be obtained from a parent or legal guardian.), (iii) contains no matter that is scandalous, obscene or libelous or otherwise contrary to law; and (iv) contains only information and data that is true and accurate to the best of Entrant’s knowledge, belief, and expertise. Additionally, you are granting Sponsor an irrevocable, royalty-free, worldwide right and license to: (i) use, review, assess, test and otherwise analyze your entry and all its content in connection with this Sweepstakes; (ii) publish the entry for Sponsor’s online and printed publications, including on Sponsor’s websites. Publications or presentations can include but are not limited to newsletters, brochures, fundraising appeals, public service announcements, grant proposals, reports, awards, thank-you cards, displays, mailings and invitations, and (iii) feature your entry and all its content in connection with the promotion of this Sweepstakes in all media (now known or later developed). You agree to sign any necessary documentation that may be required for us to make use of the rights you granted above; understand and acknowledge that we may have developed or commissioned materials similar to your submission and you waive any claims you may have resulting from any similarities to your entry; understand that we cannot control the incoming information you will disclose to our representatives in the course of entering, or what our representatives will remember about your entry. By entering this Sweepstakes, you agree that use of information in our representatives’ unaided memories in the development or deployment of our products or services does not create liability for us under this agreement or copyright or trade secret law; understand that you will not receive any compensation or credit for use of your entry, other than what is described in these Official Rules. Please note that following the end of this Sweepstakes your entry may be posted on a website selected by us for viewing by visitors to that website. We are not responsible for any unauthorized use of your entry by visitors to this website. While we reserve these rights, we are not obligated to use your entry for any purpose, even if it has been selected as a winning entry.
If you are unable or do not want to grant us these rights to your river story entry, please do not enter.
GENERAL CONDITIONS / RELEASE: By participating, Entrant agrees to (a) release Sponsor, its respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by (i) Entrant’s participation, and if a winner, acceptance of the prize or prizes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; (ii) any Sweepstakes Entities sponsorship or administration of the Sweepstakes; and (iii) Entrant’s and/or any third party’s use, sale or disposal of the prize; (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize (any written warranty by the manufacturer concerning the prize will be provided along with the prize). Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or Website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this Sweepstakes.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Sweepstakes is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of Entrants, technical failures or any other causes which in the opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any suspect Entry or Entrant and/or to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination or suspension, notice thereof will be posted at www.5000Miles.org. If the Sponsor decides to reconvene the Sweepstakes after a suspension, the determination of the prize winner will be made, from among all eligible, non-suspect Entries received as of the date of the suspension, as Sponsor determines in its sole discretion. Entries not complying with all rules are subject to disqualification.
DISPUTES: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the District of Columbia (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the District of Columbia.
